This June 26, 2015 opinion and order from the U.S. District Court for the Western District of Wisconsin addresses claims brought by Todd A. Carlson, a City of Superior police officer, against Tactical Energetic Entry Systems, LLC (TEES) and Maxum Casualty Insurance Company. Carlson alleged negligence and violation of Wisconsin’s Safe Place Statute arising from an injury sustained during a 2011 tactical training exercise at Volk Field. Judge William M. Conley granted partial summary judgment, dismissing the Safe Place claim and all but one negligence theory, allowing Carlson to proceed solely on a claim that TEES failed to warn trainees about the absence of a wall below a roofline during a “spider-hang” exercise.
